Overview

This website and service are operated by Everfree Designs. Throughout the site, the terms “we”, “us” and “our” refer to Everfree Designs. We offer EverFree 3D, including all information, tools and services available from this site, to you conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site, creating an account, purchasing credits or a subscription, and/or exporting files, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including additional terms and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Any new features or tools added to the Service are also subject to these Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the Service following the posting of any changes constitutes acceptance of those changes.

Payments for subscriptions and credit packs are processed by Stripe. Authentication and related account services may be provided by third-party providers we use to operate the Service.

1. The Service

EverFree 3D is a digital design platform. You customize templates and export production files (such as STL, 3MF, or SVG packages) for use with your own printer or a print service you hire. We do not manufacture, print, pack, or ship finished physical products.

You may not use the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright and trademark laws). You must not transmit worms, viruses, or any code of a destructive nature. A breach of these Terms may result in suspension or termination of your access to the Service.

2. General conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including payment card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Payment card information is handled by our payment processor and encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service, without our express written permission. The headings used in this agreement are for convenience only and will not limit or otherwise affect these Terms.

3. Accuracy, completeness and timeliness of information

We are not responsible if information made available on this site is not accurate, complete or current. Material on this site is provided for general information and should not be relied upon as the sole basis for decisions without consulting primary sources. Any reliance on the material on this site is at your own risk. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

4. Modifications to the Service and prices

Prices for subscriptions, credit packs and other offerings are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

5. Credits, exports and commercial use

Designing and previewing is free. Credits are charged when you export a new design version. Re-downloads of an already unlocked version do not consume additional credits. Credits relate to design exports and revisions, not to how many physical units you later print.

Paid subscription and credit-pack exports include commercial-use rights for physical products you make and sell. Free trial exports are personal/testing use only. Digital file resale and redistribution are never included.

Commercial use covers physical products you make. The exported digital files themselves may not be sold, shared, redistributed or uploaded as downloadable products.

EverFree credits are based on exported design versions, not on how many physical units you print. An eligible commercially licensed export can be used to produce multiple physical copies.

Commercial rights already granted to eligible paid exports remain valid for those exported versions even if your subscription later ends.

Your commercial-use rights are non-exclusive. Other EverFree users may create or sell products using the same base templates.

Commercial rights attach to eligible paid exports made by the account holder (or the business using that account). They are not transferable as a raw digital-file license to another seller. Using a manufacturing service to print your licensed design on your behalf is permitted.

We have made every effort to describe the Service accurately. We do not warrant that the quality of any files, services, information or other material obtained through the Service will meet your expectations, or that any errors in the Service will be corrected. Display of colours, previews and dimensions on your device may differ from printed results.

6. Billing, accounts and refunds

Subscription and credit-pack purchases are processed securely by Stripe. You agree to provide current, complete and accurate purchase and account information, and to promptly update your account information (including email address) so we can complete transactions and contact you as needed.

We reserve the right to refuse any order or purchase. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per account or per order, including where purchases appear abusive, fraudulent or intended for unauthorized resale of the Service itself.

Refunds: once credits have been used to complete an export, that purchase is not eligible for a refund for the consumed credits. Other refund requests (for example unused credits or subscription billing issues) are considered case by case. If a payment is refunded or charged back, we may revoke related unused credits and, where appropriate, commercial rights tied to that payment. Credit activity history is retained for support review.

You may cancel a paid subscription through your account billing controls (or as otherwise made available). Cancellation typically takes effect at the end of the then-current billing period unless otherwise stated at cancellation. Canceling a subscription does not by itself erase commercial-use rights already granted for eligible paid exports; see Section 5.

7. Optional tools and third-party services

We may provide access to third-party tools or services over which we neither monitor nor have full control. You acknowledge that such tools are provided “as is” and “as available” without warranties, representations or conditions of any kind and without endorsement. We shall have no liability arising from or relating to your use of optional third-party tools. Any use is at your own risk and discretion; you should review the terms of the relevant third-party provider(s).

8. Third-party links

Certain content, products and services available via the Service may include materials from third parties. Third-party links may direct you to websites that are not affiliated with us. We are not responsible for examining or evaluating third-party content or accuracy, and we do not warrant and will not have any liability for third-party materials, websites, products or services. Complaints, claims or questions regarding third-party products should be directed to the third party.

9. Your content, feedback and submissions

You are responsible for having permission to use any artwork, logos, trademarks or other content you upload or add to your design. Paying EverFree does not grant rights to content you do not own.

Built-in EverFree assets and fonts are subject to their applicable licenses. Prefer assets you created or have clear permission to use.

If you send creative ideas, suggestions, proposals, plans or other materials (“comments”) to us, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use those comments in any medium. We are under no obligation (1) to keep comments confidential; (2) to pay compensation for comments; or (3) to respond to comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates any party’s intellectual property or these Terms.

You agree that your comments and uploads will not violate any third-party right, including copyright, trademark, privacy, personality or other proprietary right, and will not contain libelous, unlawful, abusive or obscene material, or malware that could affect the Service. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any content. You are solely responsible for content you submit and its accuracy.

10. Personal information

Your submission of personal information through the Service is governed by our Privacy Policy. Questions may also be sent to everfreedesigns@gmail.com.

11. Errors, inaccuracies and omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions, offers, credit amounts or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel purchases if any information in the Service is inaccurate at any time without prior notice (including after you have submitted a purchase). We undertake no obligation to update, amend or clarify information in the Service except as required by law.

12. Prohibited uses

In addition to other prohibitions in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may affect the functionality or operation of the Service or related systems; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; (k) to interfere with or circumvent the security features of the Service; (l) to sell, share, redistribute or upload exported digital files (such as STL, 3MF, SVG or ZIP packages) as downloadable products in violation of Section 5; or (m) to otherwise misuse the Service, including attempts to circumvent credit, billing, licensing or access controls. We reserve the right to terminate or suspend your use of the Service for violating any of the prohibited uses.

13. Disclaimer of warranties; limitation of liability

We do not guarantee, represent or warrant that your use of the Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered to you through the Service are (except as expressly stated by us) provided “as is” and “as available” for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

In no case shall Everfree Designs, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content posted, transmitted or otherwise made available via the Service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend and hold harmless Everfree Designs and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party (including claims related to content you upload or designs you distribute or sell).

15. Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

16. Termination and account suspension

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us.

You may stop using the Service at any time. You may cancel a paid subscription as described in Section 6. Canceling a subscription or ceasing use does not automatically delete all account data; contact us if you need help with account closure requests.

We may suspend or terminate your account or access to the Service at any time, with or without notice, if in our sole judgment you fail, or we suspect that you have failed, to comply with these Terms, or if we suspect misuse, fraud, abuse, intellectual-property infringement, circumvention of credits or licensing, or other harmful conduct, or if we otherwise determine that suspension or termination is reasonably necessary to protect the Service, other users or us. We also reserve the right to refuse service to anyone for any reason at any time.

Upon termination or suspension, you remain liable for all amounts due up to and including the date of termination. We may deny you access to the Service (or any part thereof). Commercial-use rights already granted for eligible paid exports remain subject to Section 5, except where those rights were obtained through payment that is later refunded, charged back or obtained through misuse or fraud.

17. Entire agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including any prior versions of these Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

18. Governing law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
